HBA of Metro Denver Prepares for Local Government Adoption of the 2024 ICC Building Codes

With new international and statewide building and energy codes as well as numerous local municipalities considering adoptions, this year is shaping up to be an active one for code changes. Rest assured, the HBA of Metro Denver will be closely monitoring these developments as counties and municipalities consider code amendments and implementation. The HBA Permitting Committee provides an ideal forum for these discussions, providing a natural forum for municipal staff and HBA members to share code updates and insights within local governments across the metro area.

The HBA of Metro Denver has already submitted comments in Adams County and Brighton on proposed fire-sprinkler codes within those jurisdictions. This summer, we plan to host a Permitting Committee-sponsored webinar to provide members with critical code updates at the local, state and national levels, featuring expert analysis.

Commerce City Implementing Revisions to Impact Fee Assessments

In the spring of 2023, Commerce City implemented substantial revisions to its Public Parks and Recreation Fee, Drainage Fee and Road Impact Fee. Additionally, three new impact fees were introduced, each applicable to specific categories such as public safety, general government and public works.

Since the implementation of these fees, the City has assessed them to all new residential and commercial developments within its jurisdiction. As of March 24, 2025, Commerce City has adopted a revised approach to the assessment of impact fees, in alignment with Colorado regulations governing the adoption of new impact fees. It is important to note that this revised assessment procedure only applies to impact fees and does not affect land use application fees, permit fees, fees in lieu of dedication, use taxes, or any other general development-related fees.

Currently, the City is in the process of updating pending permits to reflect the accurate assessment of either the 2023 fee schedule or the previous impact fee schedule. Over the next two months, the City will conduct an audit of all permits issued between January 1, 2024, and March 23, 2025, for new residential or non-residential construction, to ensure compliance with the new assessment procedures. Permits issued prior to January 1, 2024, were not affected or were previously corrected and issued refunds.

Any permit that was incorrectly assessed under the revised procedures will be adjusted and a refund issued for any difference in impact fees collected.

Further details regarding this effort will be communicated as they become available. Questions regarding the new assessment procedures may be directed to cdpermits@c3gov.com. The City requests that any inquiries include the permit number or subdivision information to facilitate a prompt response.
